Using abusive words on the visual and audible channels, particularly, on the live stream such as on the (TV) and Radios, it becomes a common phenomenon, in spite of that exploiting the freedom of opinion for ill-suited purpose, according to the press laws those who insult others have to be punished.
Dr. Mubdr Louis says, abusing a simple transitive word for breaking the reputation, prestige or injuring someone’s sense, insulting words cannot remain last long in human being’s memory, it is one of the reasons in order to frustrate someone. Moreover, the Iraqi penalizing law (111) in the article (434) in (1969) concentrated on the abusing definition as we mentioned above.
Why Offending will be seen as a Crime?
There are some factors that say abusive words are a crime because it is an immoral phenomenon of community, human beings should be respected. Moreover, it inserts the social security into jeopardy, for example, abusing a political party or a leader, it causes social and political chaos in the society. Besides, there is no justification or social interest to insult others while the crime of insulting cannot improve because the doer uses such a negative word due to he or she says the truth. That’s why the punishment of insulting is not the last longing.
According to the article (434) the amended Iraqi penalizations law, number (111) in (1969), the abusing punishment is not more than one year of prison and the fines, not more than (1, 000,000), if it spreads on the visual channels the penalty will be heavier. The same material mentioned for journals as well, if a journal publishes a satire topic its fine is not less than (5, 000,000) and not more than (20, 000,000) Iraqi dinars. If the journal repeated the abuse once again, the courts have such a right to escalate its financial penalty.
Why insulting penalization is more drastic on the advertisement channels?
Because people see or listen to the news either on (TV) or radio and will impact on the personality of those people who insulted. Furthermore, offending through the (TV) channels encourages people to repeat those unpleasant words more and more and it spreads rapidly inside the community. In contrast, the punishment of audible devices fewer than the visual one, for instance, in Sulaimani such a case would happen through mobile phone, as a result, the insulter didn’t take a heavy punishment because the abuse has happened between two people on the phone and no one knew about their quarrels.
Who will punish?
Obviously, the journalists in general and people particularly have to know that reality, the freedom atmospheres of the advertisement channels are not created to use the prohibited word and insult others whereas there are many ways to alert people such as a productive critique is better than gossiping or scandal. In spite of this, freedom borders required to be protected.
On the publishing organizations (insulator) or author who is an ordinary person or a journalist has a similar responsibility as an editor in chief and head of staff, every topic has to be filtered through editor in chief, and the direct responsibility is on the shoulder of editor in chief. Although the head’s responsibility is financial this means fines or compensation while he or she didn’t participate in the crime directly.
